INTRODUCTION

Argenbright Security Europe Limited (“ASEL”) is a private security company that supports a number of UK retailers, wholesalers, transport and distribution companies.

ASEL is committed to protecting the privacy and security of your personal data. This privacy notice describes how we collect, use, and protect your personal data in accordance with the UK General Data Protection Regulation (GDPR) and other relevant data protection laws.

 

DEFINITIONS

Controller – Argenbright Security Europe Limited is the organisation which determines the purposes and means of the processing of personal data.

Processor – A natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
Recipient – A natural or legal person, public authority, agency or other body, to which the personal data is disclosed, whether a third party or not.
Third Party – A natural or legal person, public authority, agency or other body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.
Personal Data – Any information relating to an identified or identifiable natural person (“Data Subject”) An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
Special Category Personal Data – Any information relating to an identified or identifiable natural person (“data Subject”) which falls into one of the following categories. Racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health, data concerning a person’s sex life, data concerning a person’s sexual orientation.
Data Subject – Any identifiable natural person, who’s personal data is processed by the controller responsible for the processing, in this case this is your data as an ASEL employee.

HOW DOES ASEL GET YOUR INFORMATION

ASEL gets your information from a number of sources, these include:

  1. Directly from you at the beginning of your recruitment journey with ASEL and during your employment.
  2. From an employment agency.
  3. From references, either internal or external.
  4. From the Disclosure and Barring Service where you give them permission.
  5. From occupational health and other health service providers.
  6. From pension administrators and other government departments for example HMRC where they may share your tax details.
  7. From providers of employee benefits.
  8. From our customers where they are the Data Controller, and they share CCTV including your images with ASEL.

 

REASONS FOR PROCESSING YOUR INFORMATION

Induction and ongoing Employment

As an employee of ASEL the organisation needs to hold and process some of your data, we do this in order to perform our contract with you. Some of the reasons we use your data are listed below:

  • In order to engage with you during the recruitment and onboarding process
  • To enable ASEL to conduct your initial vetting
  • In order to check you are legally entitled to work in the UK
  • To ensure that we are able to determine the terms under which you work for us
  • To determine whether your engagement is deemed employment for the purpose of Chapter 10 of Part 2 of the Income Tax (Earnings and Pensions) Act 2003 (ITEPA 2003) and providing you with a status determination statement in accordance with the applicable provisions of ITEPA 2003
  • Paying you, calculating tax and National Insurance contributionsProviding various employee benefits to you
  • Enrolling you in a pension arrangement in accordance with our statutory automatic enrolment duties.
  • Administering the contract we have entered into with you.
  • Business management and planning including accounting and auditing.
  • Scheduling shifts and communicating those schedules to you

Performance Management

  • Monitoring employee attendance and timekeeping
  • Conducting performance reviews, managing performance and performance requirements
  • Decision making in terms of salary reviews and compensation, including any bonus payments
  • Making decisions about promotions
  • Gathering and processing evidence about complaints, grievances or disciplinaries raised
  • Making decisions about your continued employment
  • Making decisions about termination of our contract with you
  • Education, training and development requirements
  • Dealing with legal disputes involving you, or other employees, workers and contractors, including accidents at work
  • Ascertaining your fitness to work
  • Managing sickness and absence
  • Complying with health and safety obligations
  • To prevent fraud
  • For statistical analysis to understand how happy you are as an employee and identify opportunities to improve our offering as an employer

Information Security

  • Use of our information and communications systems to ensure compliance with information security policies
  • To ensure network and information security, including preventing unauthorised access to our computer and electronic systems and preventing malicious software distribution

Other

  • Equal opportunities monitoring
  • Recording a reporter / witness against an incident report

 

WHAT DATA DO WE COLLECT AND PROCESS

In order to achieve our purpose, we may collect the following personal data:

  2. Date of Birth
  3. Gender
  4. Marital Status
  5. Nationality
  6. Next of kin and emergency contact information
  7. National insurance number
  8. Bank account Details, payroll records and tax status information
  9. Salary, annual leave, pension and benefits information
  10. Start date and date of continuous employment
  11. Leave date and reason for leaving
  12. Location of your employment or workplace
  13. Forms of identification (SIA license, passport and proof of address etc)
  14. Recruitment information

  20. Information about your use of our IT and information systems

We may also process special category data, which is data of a more sensitive nature, the following data types may apply:

  1. Race and or ethnic origin
  2. Details of suspected criminal offences
  3. Details of civil action taken against individuals
  4. Information about your race or ethnicity and religious beliefs
  5. Information about your health, including medical conditions, sickness records
  6. Information about statutory parental leave and sickness leave
  7. Information about criminal convictions and offences

 

YOUR RIGHTS AS A DATA SUBJECT

UK GDPR affords you with a number of rights, your rights are summarised below. ASEL is committed to supporting you with these rights where required and so you may contact our designated Data Protection Officer dpo@asel.co.uk or your line manager at any time to exercise these rights.

The right to request access – You have the right to obtain from ASEL free information about your personal data and a copy of the personal data we store (commonly known as a “Subject Access Request”), furthermore you have the right to obtain information as to whether your personal data is transferred to any third countries or international organisations. Where this is the case, you have the right to be informed about any safeguards relating to this transfer.

Right to rectification – You have the right to obtain from ASEL without undue delay the rectification of inaccurate personal data concerning you. Basically, if we hold incorrect data about you, you have the right to have that data corrected.

Right to erasure (right to be forgotten) – UK GDPR grants you the right to have your data deleted when there is no good reason for us to continue to process it. ASEL have an obligation to erase your data without undue delay where one of the statutory grounds applies, as long as the processing is not necessary.

Right of Restriction of Processing
You have the right to obtain from ASEL a restriction of processing where a statutory reason applies. This enables you to ask us to suspend processing your data, for example if you want us to establish its accuracy or the reason for processing it.

Right to data portability
You have the right to receive personal data we process concerning you in a structured, commonly used, and machine-readable format. You have the right to request the transfer of your data to another party.

Right to Object
You have the right to object to us processing your personal data, on grounds relating to your situation at any time. This does not mean that we will stop processing your data, but we will review your objection in each case.

Automated individual decision-making, including profiling
You have the right not to be subject to a decision based solely on automated processing, including profiling.

Right to withdraw consent
Where ASEL uses consent as its lawful basis to process your data, you have the right to withdraw your consent.

Right to complain to the supervisory authority

HOW TO EXERCISE YOUR RIGHTS

You will not usually pay a fee to access your personal data or to exercise any of your other rights. We may charge a reasonable fee if your request for access is unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances. If you wish to exercise your rights, then please contact us at dpo@asel.co.uk.

 

WHAT IS OUR LEGAL BASIS?

ASEL uses the lawful basis “performance of a contract” for the majority of the data processing which includes employee data, this is a documented lawful basis under Article 6(b) of UK GDPR. ASEL may also use an alternative lawful basis dependant on the nature of the data processing activity.

The lawful basis ASEL use are….

  1. Legal Obligation (Article 6(1)(c))
  2. Performance of a Contract (Article 6(1)(b))
  3. Legitimate Interests (Article 6(1)(f))
  4. Vital interests (Article 6(1)(d))

Where ASEL processes Special Category Data, for example criminal conviction data, or health data the additional basis we rely on are as follows…..

  1. Explicit Consent (Article 9(2)(a))
  2. Carrying out the obligations and exercising specific rights of the controller or the data subject in the field of employment and social security
  3. and social protection law (Article 9(2)(b))
  4. Vital Interests where you are incapable of giving consent (Article 9(2)(c))
  5. For the establishment, exercise or defence of legal claims (Article 9(2)(f))
  6. Where processing is necessary for reasons of substantial public interest (Article 9(2)(g))
  7. For archiving purposes in the public interest (Article 9(2)(j)

Where we process information about staff criminal convictions and offences, the lawful basis we rely upon is….

  1. For the performance of a contract (Article 6(1)(b)) and the processing condition in Schedule 1 part 1 paragraph 1 of the DPA 2018.

 

DO WE SHARE YOUR DATA WITH THIRD PARTIES?

ASEL will share your data with third parties where the law requires it, where it is necessary to administer our relationship with you or we have another Legitimate Interest to do so.

As the Data Controller ASEL have implemented appropriate technical and organisational measures to ensure your Personal Data always remains secure.
